Terms of Use
1. What this service is
ProABA (hereinafter - the "Service") is a digital tool for professional ABA specialists, curators and centers. It helps maintain student profiles, skill checklists, progress graphs, teaching protocols, ABC behavior analysis, PECS communication, online sessions and reports.
The Service is actively evolving. We regularly add new features and fix bugs. The Service is provided "as is" - see section 6 regarding warranties.
These Terms are a public offer. Registering in the Service or using it means full and unconditional acceptance of these Terms. If you do not agree with them, do not use the Service.
The Privacy Policy and the Refund Policy form an integral part of these Terms.
2. Definitions
In these Terms the following words have the following meaning:
- Service ("ProABA") - the ProABA web application at pro-aba.net together with all of its features, pages, interfaces and content.
- Administration (also the Service Provider) - individual entrepreneur (Ukrainian FOP) Yuliia Anatoliivna Lastovetska, who owns the Service, keeps it running and provides the services under a Subscription. The Service and the Administration are different entities: the Service is a program, the Administration is the one who provides the service and with whom the User enters into a contractual relationship. The term "Administration" is used throughout the rest of this text.
- User - a natural person who has created an account in the Service: a specialist, curator, supervisor, specialist's assistant, a center representative, or a parent granted access by a specialist.
- Data - any information entered by the User into the Service or created within the Service during work: student records, trial results, progress charts, protocols, notes, files and documents.
- Subscription - the right to use the Service on the chosen plan for the paid period.
- Plan - the set of Subscription limits: the number of active students and the team size.
3. Who can use it
The Service is intended for:
- professional ABA specialists;
- BCBA curators and supervisors;
- specialist assistants (RBT);
- ABA centers with a team (via the “Center” and “Network” plans with the organizational model);
- parents of students - through read-only access granted by a specialist via the system.
By registering as a specialist, you confirm that:
- you are at least 18 years old;
- you have appropriate education or training in applied behavior analysis (ABA);
- you will enter student data only with written consent from their parents or legal guardians.
4. What ProABA is NOT
The Service is a documentation tool. It does not replace:
- the specialist's professional education;
- medical consultation or diagnosis;
- BCBA supervision;
- the specialist's own professional responsibility.
All decisions regarding therapy, diagnosis, approach and methodology are made by you as a specialist. We only provide a digital form for recording what you have decided.
The Service is not a medical device and has not undergone conformity assessment as one. It does not diagnose, does not prescribe or adjust treatment, and gives no medical or clinical advice. Any decision about a child's health is made by a qualified professional on their own assessment, not on prompts or calculations from the program.
We do not guarantee results. The Service does not promise, and cannot promise, any therapeutic, educational or other outcome for a child. Progress depends on the child, on the professional's work and on many circumstances outside the Service. Examples, screenshots and feature descriptions show how the program is built, not what result you will get.
AI assistant. The Service includes an AI assistant - a help tool that explains how the program works and where to find things. You are talking to an AI, not a person. The assistant does not give advice about a specific child, does not make diagnoses, does not change programs and does not do anything in the Service on your behalf. It can make mistakes, so check anything important against the screen. Whether and how to use an answer is your decision. Prices, plans and rules apply as set out on the pricing page and in these Terms; if an answer from the assistant differs from them, the pricing page and these Terms prevail. Do not give the assistant names, diagnoses or any other data that could identify a child.
5. Your obligations
By registering and using the Service, you commit to:
- Obtain written consent from parents / guardians before entering any child's data.
- Not share your login / OTP codes with other people.
- Not enter clearly false data.
- Not use the Service for unlawful purposes.
- Follow professional ethics (for example, BACB Ethics Code, ABAI Guidelines or equivalent).
User warranties. By using the Service, the User warrants that they:
- hold written consent from the parents or legal guardians for processing the data of every child they enter into the Service, and keep that consent;
- have a legal basis for processing the data they enter and act within their own professional competence;
- enter data that does not infringe the rights of third parties.
Indemnity. If a claim is brought against the Administration by a third party - in particular parents, a child's legal representatives or a supervisory authority - because the User breached these warranties or these Terms, the User shall reimburse the Administration for proven losses, fines imposed and reasonable legal costs.
What may be uploaded. The User uploads to the Service only what is needed to work with a student: documents, photographs, audio and video recordings of sessions. It is prohibited to upload material unrelated to therapy, material that infringes the rights of third parties, or material containing threats, discrimination, scenes of violence or content of a sexual nature.
The Administration does not pre-screen uploaded material but may remove material that breaches this rule and suspend the User's access. The User is responsible for what they upload.
6. Our obligations
- Store your data in secure infrastructure (see the Privacy Policy).
- Notify you about material changes to the Terms or Policy.
- Fix critical bugs as soon as possible.
- Respond to data requests within 30 days.
We do everything we can to keep the Service stable, but we do not guarantee 100% uptime, performance or full absence of technical errors. The Service is provided "as is".
7. Liability
The specialist is responsible for:
- obtaining parental consent;
- the accuracy of the data entered;
- professional decisions made based on this data.
ProABA is not responsible for:
- consequences of therapeutic decisions made by the specialist;
- decisions the User makes on the basis of answers from the AI assistant (section 4);
- actions of third parties (parents who saw data through legal means);
- data loss due to force majeure as described below (although we maintain backups);
- compliance with additional jurisdictions that data may reach through user actions (for example, exporting to Word and sending by email).
The Service is provided "as is" and "as available". The Administration gives no express or implied warranties as to the fitness of the Service for the User's particular purposes. This covers uninterrupted operation, freedom from technical errors, and the Service meeting the User's expectations.
The User uses the Service at their own risk and bears full responsibility for the professional decisions they make, for the data they enter, and for the consequences of using it.
The Administration of the service is not liable for any indirect, consequential or incidental damages, lost profit, loss of data or reputational loss of the User arising from the use of, or inability to use, the Service.
The Administration is not liable for outages, delays or refusal of service caused by the acts of third parties - payment systems, hosting providers, data centers, API and integration vendors on which the Service depends.
Should the Administration nevertheless become liable, its aggregate liability is limited to the amount actually paid by the User for the Subscription during the twelve months preceding the event.
The limitations in this section do not apply to liability for intent or gross negligence, for harm to life or health, or where the law does not permit such liability to be limited or excluded.
Force majeure. The Administration is not liable for failure to perform, or improper performance of, its obligations where this is caused by force majeure - extraordinary and unavoidable circumstances that arose beyond the Administration's control and that it could neither foresee nor prevent by reasonable measures.
Force majeure includes, but is not limited to:
- wartime circumstances - war, armed aggression, hostilities, occupation or the threat of occupation, martial law, a state of emergency, general mobilisation, curfew;
- consequences of hostilities - shelling, missile and drone attacks, air raid alerts, explosions, mining, damage to or destruction of critical infrastructure;
- power and communications outages - emergency, rolling or scheduled power cuts, interruptions in the electricity supply, damage to communication networks, loss of or restricted access to the Internet;
- failures at the providers the Service depends on - outages, failures and discontinuation of service by hosting providers, data centers, payment systems, API and integration vendors;
- unlawful acts of third parties - acts of terrorism, sabotage, cyberattacks including DDoS, unauthorised interference with equipment or software;
- civil unrest - riots, revolution, strikes, lockouts, blockades of transport routes;
- natural disasters - fires, floods, earthquakes, hurricanes, landslides and other natural catastrophes;
- epidemic circumstances - epidemics, pandemics, quarantine and other anti-epidemic restrictions;
- acts of public authorities - acts of state and local government bodies (prohibitions, sanctions, restrictions, changes in legislation) that make performance impossible.
For the duration of force majeure, the time for performance of the Administration's obligations is extended by the period of those circumstances and their consequences. The Administration notifies Users of such circumstances within a reasonable time - by email or by a message in the Service, where technically possible.
Force majeure does not release the User from the obligation to pay for services already provided.
A certificate issued by the Ukrainian Chamber of Commerce and Industry, or by another authorised body, is proper evidence of the occurrence and duration of force majeure.
If force majeure continues for more than 60 consecutive calendar days and makes the provision of services impossible, either party may terminate the Subscription by written notice to the other party.
8. Intellectual property
All intellectual property in the Service belongs to the Administration. This includes, but is not limited to: the software and source code, the design and layout, texts, graphics, images, logos, trademarks, the name "ProABA", the structure and content of the skill libraries, document templates and any other information placed in the Service.
A Subscription grants the User the right to use the Service for its intended purpose during the paid period. It transfers no rights to the intellectual property itself.
Without the written permission of the Administration it is prohibited to:
- copy, reproduce or modify the Service or its parts, or create derivative products based on them;
- decompile, reverse-engineer or otherwise attempt to obtain the source code;
- use the name, logo or visual identity of the Service in your own materials;
- reproduce the content of the Service - skill libraries, templates, texts - outside of working in the Service itself;
- use the Service, including the free plan or a trial, other than for its intended purpose: to create, develop or improve a competing product or service, yourself or on behalf of others;
- automatically collect or bulk-download the content of the Service - by bots, scripts or other means.
The Administration may close an account created or used for a competing product (section 10). These prohibitions do not limit the rights that the law grants to users of software and databases and that cannot be excluded by contract.
This rule does not apply to the User's Data: everything the User has entered into the Service remains their own data, and they may export it at any time.
So that the Service can operate, the User grants the Administration a non-exclusive, royalty-free licence to store, reproduce, technically process and back up the User's Data - solely to the extent needed to provide the services, and only for as long as the Data remains in the Service.
The Administration acquires no other rights to that Data: it does not use it for its own purposes, does not pass it to third parties beyond what is described in the Privacy Policy, and does not train any artificial intelligence models on it.
9. Pricing
The Service has five plans. Prices are in the US dollar equivalent:
- Free - free, 1 student. No credit card required.
- Standard - $10/mo or $100/year, 10 students, no team.
- Pro - $25/mo or $190/year, 25 students, team up to 3.
- Center - $39/mo or $290/year, 60 students, team up to 20. Organizational model with Owner / Curator / Supervisor / Specialist roles for centers with a team.
- Network - several centers under one management. The price consists of “Center” plus a surcharge for each branch. Every branch adds its own 60 students and 20 team seats. The number of branches is set by agreement.
Add-ons depend on the plan: nothing can be added on Free, Standard and Pro can add a seat pack only, and Center and Network can add a seat pack, a specialist pack and branches:
- a seat pack - $5/mo or $50/year for every 10 additional students; on plans with a team it also adds 3 team seats;
- a specialist pack - $5/mo or $50/year for every 5 additional team seats;
- a branch - $15/mo or $150/year each.
The limit counts active students only. The archive is unlimited, free, and does not count towards the plan limit.
All features are available on every plan. The plan affects the number of active students and the team size.
Paid plans have been in effect since September 1, 2026.
Currency and settlement. The price of a Subscription is the equivalent of the corresponding amount in US dollars listed above. Payment is made by cashless transfer through the payment system integrated into the Service.
For a User paying with a card denominated in another currency, the amount charged is the local-currency equivalent of the Subscription price at the rate of the bank that issued the User's card on the date of the transaction. The Administration neither sets nor influences that rate, so the amount actually charged may differ from the indicative one.
Existing data is not lost when changing plans. If you downgrade to a lower plan with more students - we will not delete them, but you will not be able to add new ones until you bring the count within the limit.
Price changes. The Administration may change plan prices unilaterally at any time, notifying Users by email no later than 14 calendar days before the change takes effect. For an active paid Subscription the new price applies from the next billing period. A User who does not agree with the change may cancel the Subscription before the next period begins.
Cancellation and refund terms are set out in the Refund Policy.
10. Account closure
You can delete your account at any moment by sending a request to julia.lastovetska@gmail.com. All your data (and that of students for whom you were the sole specialist) will be permanently deleted.
We reserve the right to block accounts that violate the Terms (false data, unlawful use, hacking attempts).
Suspension of access. The Administration may suspend or terminate access to the Service if the User breaches these Terms, enters knowingly false data, attempts to compromise the Service or endangers other users' data. The Administration gives the reason by email.
Termination of access for a breach of the Terms is not a ground for refunding amounts paid.
11. Changes to the Terms
We may update these Terms. We will notify you by email about material changes. If you do not agree with the changes - you can delete your account.
12. Jurisdiction
These Terms are governed by the laws of Ukraine (where the service owner is registered).
Disputes that cannot be resolved amicably are submitted to courts of general jurisdiction at the place of registration of the service owner.
13. Final provisions
Consumer rights. Nothing in these Terms limits or waives the User's rights guaranteed by consumer protection law. If any provision of these Terms conflicts with such a rule, the rule of law applies and the rest of the Terms remains in force.
Pre-action procedure. Before going to court, a party sends the other party a written claim by email. The time for a reply is 30 calendar days from receipt.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in full force. The invalid provision is replaced by a valid one closest to it in meaning.
Entire agreement. These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between the User and the Administration regarding use of the Service and supersede all prior oral or written arrangements on the subject.
Assignment. The Administration may assign its rights and obligations under these Terms in the event of reorganisation or transfer of the Service, notifying Users; the User's rights are not reduced by this. The User may not assign their rights under these Terms to third parties without the Administration's written consent.
Notices. A notice is deemed duly given if sent to the email address stated in the User's account or shown in the Service itself. The User must keep that address up to date.
Language. These Terms were drawn up in Ukrainian. Translations into other languages are provided for convenience; in case of discrepancy the Ukrainian version prevails.
